The Land and Mortgage Register Department is located in every major city in Poland. They are located next to the Courts. It is an institution that has documented knowledge of the legal status of a given property – home, flat, plot, etc. It is much easier to establish the legal status of a property via the Internet.
Application to the Land and Mortgage Register and the principles of viewing the Land and Mortgage Register
The Real Estate Office, the prospective buyer of a given real estate, a person authorized to do so on behalf of the property owner may report to the Land and Mortgage Register Department.
(transfer of a written authorization) heir or other institution authorized to view the Land and Mortgage Registers. “Request” is a technical term used in the Regulation of the Minister of Justice on establishing and maintaining land and mortgage registers in the IT system of November 21, 2013 (Journal of Laws of 2013, item 1411).
A land and mortgage register application may contain more than one request for entry in various departments of land and mortgage registers. Each request is marked with a separate mention – the last digit of the reference number indicates the request number.
In the current default version of the internet browser, maintained by the Ministry of Justice within the Access Subsystem to the Central Land and Mortgage Register Database, the request codes do not appear in the content of the land and mortgage register under review. They are visible only after switching to the old mode of viewing the land and mortgage register or when calling the full contents of the book.
Mention in the Land and Mortgage Registers
The entry in the field ” Mention” means that the District Court, Land and Mortgage Register Division received an application for entry in the land and mortgage register, the application was registered in the land and mortgage register and provided with a consecutive number. On the same day, hour and minute, in the relevant section of the land and mortgage register, in the field “Record”, the content of the note itself is introduced – in such a way that the person reviewing the book may become aware of the wording and its meaning for excluding public trust land and mortgage register.
How to plot a mortgage from the Land and Mortgage Register?
To delete a mortgage from the land and mortgage register, you must obtain a statement from the creditor (the bank that granted the loan) about repayment of the debt.
The statement must contain:
- debtor’s details,
- the number of the land and mortgage register in which the mortgage entry was made,
- the title of the mortgage along with an indication of the amount of debt,
- confirmation that the debt secured by the mortgage has been repaid in full,
- permission to delete a mortgage from the land and mortgage register along with all entries related to it.
The statement issued by the Lender must be signed by two persons authorized to represent the given bank. If our creditor is not a bank, then the statement must be confirmed by a notarized signature.
